Please remember that we are the only organzation in the U.S. whose exclusive purpose is to advocate in the courts for some level of continued broadcast decency on television and radio. We operate on a small efficient budget, and are up against the entire television broadcasting network industry with their multi-million dollar budgets to accomplish their agenda with high priced law firms. Our work does require thousands of dollars of expenses, and hundreds of hours of legal work. We operate on a no-debt basis, and with no grant monies, so must rely on individual contributions to continue this battle. Donations are a matter of individual choice. We only ask that those considering a donation keep in mind that the results of the current court cases will likely be irreversible in their effect on what may or may not be broadcast into homes and public places permanently. Unfortunately, the FCC cannot and does not do all that is necessary to enforce the broadcast decency laws enacted by the nation's citizens through Congress. If the networks succeed, there will probably never again be any limitation on broadcast content, whatsoever, at any time of day. Our Congress would lose all power to regulate our public broadcast airwaves for content.
In particular, the Courts of Appeals are now going to consider whether it is constitutional for the FCC to regulate "fleeting" profanity or nudity at any hour of day on broadcast TV or radio. The Courts may even go so far as to exceed their powers by finding that the laws and regulations that limit broadcast indecency are entirely unconstitutional, attempting to strike them down completely and permanently, so that there would be no limit on what could be said or shown on TV or radio at any time in the future. (The legal prohibition against broadcast obscenity would remain on the books, but thanks to prior court decisions, virtually nothing is legally obscene, even most of the hardest core pornographic movies). It is expected by all of us involved that these cases will return to the U.S. Supreme Court in the next year or two. A District Court has also been asked by Fox to strike down all restrictions. This will permanently and irrevocably determine, forever more ,what can and will be broadcast into your homes and public places. Be assured that if we receive the necessary donations to do so, we will continue to advocate for decency and the rule of law in these cases!
